Misdemeanors

A misdemeanor is a crime punishable by maximum confinement of one year in county jail. Misdemeanors also carry fines, usually a maximum of $1,000.00. Misdemeanor defendants are guaranteed the same constitutional rights as felony defendants because of the seriousness of the charges the potential to receive a jail sentence. Misdemeanor cases can be as complex as felony cases can go on for several months.

Trial defense

When a plea deal cannot be reached, or even offered by the prosecution, or the client exercises the fundamental right to a trial, a lawyer must be skilled enough to take the case to trial.  A trial lawyer’s responsibilities include preparing the case for trial, investigating and locating witnesses, crafting defense theory of the case, creating a thorough record, arguing motions, picking a jury and trying the case.

Trial lawyers know the methods of obtaining the best possible defense for their client.  Trial lawyers are skilled in the art of selecting a jury, conducting cross-examinations and direct-examinations, and delivering persuasive and compelling opening and closing statements.  Trial lawyers perform under pressure because the stakes are high during a courtroom battle.  They need a strong presence and communication skills.  Great trial lawyers do not shy away from a fight but rise to meet the challenge. They like to fight for their clients.  They like to win. Even though most cases do not go to trial, it is at trial that true criminal defense attorneys are made.

PRE-CHARGE REPRESENTATION AND CRIMINAL INVESTIGATIONS

If you have been accused of a crime or are under criminal investigation you must hire an experienced criminal defense attorney as soon as possible. Many times, unrepresented individuals trying to help themselves out of problem inflict irreparable harm instead by talking to the police. The police build a case against you during their interview and investigation. Golden rule: Never talk to the police without an attorney. Ever.

The pre-charge stage is the most crucial time to hire an experienced criminal defense attorney. Those who do not find themselves with criminal charges that may have been prevented. The time before you are charged with crime provides a crucial opportunity for experienced criminal defense attorneys to try to persuade the prosecutor not to bring any charges or influence and reduce the severity of the charges which may be brought against you. Proactive experienced criminal defense attorneys can protect you.

Probation violations

Probation violations occur when a person placed on probation violates the terms set by the court. you break the terms or conditions of your probation. The punishment for violating probation depends on a variety of factors, such as the nature and seriousness of the violation, whether the person has violated probation in the past, and whether there are circumstances that may offer a valid explanation as to why the violation occurred. A probation violation conviction may result in jail time, fines and costs, extended probation, increased drug or alcohol testing, or more.

Felonies

Crimes are classified by the degree of seriousness, Crimes are either felonies or misdemeanors. A misdemeanor carries a penalty of up to one year in the county jail, while a felony, a more serious offense, is prosecuted by the state prosecutor and generally carries a maximum sentence of more than one year in prison and depending on the charge, can carry a life sentence without the possibility of parole

Traffic tickets

While a traffic ticket is not a criminal offense and does not have the risk of jail time, the consequences of a traffic violation can have serious and costly repercussions. An attorney who will eliminate or reduce the points on your license will save you thousands of dollars in insurance rates over time.

Plea negotiations

Plea negotiations describes the process where an agreement is negotiated between the prosecuting and defense attorney in order to resolve a case.

Sometimes the prosecutor has a strong case supported by the evidence. A conviction is more likely than not. In those instances, a client may want to seek a plea deal rather than face the risk of losing at trial and the conviction of a greater offense. While every client wants his or her case dismissed or to be found “not guilty,” it is not always wise to take an the all or nothing approach to a case when the odds are not favorable. This is especially true when a favorable plea deal can be negotiated. An excellent plea deal can save a client, jail time, severe convictions, money and much more.

expungements

Setting aside a Michigan criminal conviction is the process that removes your public criminal record. This process is typically called an “expungement.” In Michigan, there is only one process expunge a Michigan criminal conviction from your adult record. There are numerous reasons that people want to expunge a felony or misdemeanor. A felony conviction (and even misdemeanor) can affect employment, education, career advancement, and firearm rights, and many other opportunities.

Lawyers should be chosen because they can demonstrate a history rich in human traits, the ability to care, the courage to fight, the will to win, a concern for the human condition, a passion for justice and simple uncompromising honesty. These are the traits of the lawyer.
